battery
what if u didnt touch the person and they call the police for your house and the person the call the police dont go to jail but the person who was blamed when to jail for a day and got out on ( r.r ) b/c the ( fomer person who call the police) testify and say that i should be here and that judge ask (fomer ) should i stay or be release and ( fomer say be release. ask this do i need a lawyer??? can i just go to court without a lawyer??? answer to question. this is my 1st misd.battery

It doesn't mater what the alleged victim wants now, it is not them versus you, it is the state of florida versus you, and the state can go forward regardless of the victim's wants or wishes. As for representing yourself I would advise against it. You don't have experience and could very well make statements in court that could be used against you. If you can aford an attorney get one. I agree with the previous writer. You DO NOT want to go into court on a criminal charge without an attorney. Even though this is your first domestic battery, it is still a first degree misdemeanor, punishable by up to one year in the county jail or one year probation.
You may be eligible for a diversion or PTI program, whereby the case may be dismissed against you if you successfully complete the program.
