The maximum possible penalty is up to one year in jail, or one year probation, or a $1,000 fine. Additionally, you may be required to complete a Batterers Intervention Class or attend an Anger Management Class. Also, if the person was injured there may be a mandatory five day jail sentence. Also, if convicted, the offense can never be sealed or expunged from your record.

The likely sentence would be probation and the class.

You should contact an attorney, as many times these offenses can be dropped if the victim is unwilling to cooperate.

A simple Domestic Violence Battery charge has a maximum sentence of 1 year county jail, $1000 fine. Many times these cases can be resolved with probation and a Battery Intervention Class. If the Victim does not want to proceed, its possible to have the case dismissed. There are a multitude of sentences that could be imposed ranging from court costs and probation to 364 days in jail. Domestic Violence is treated differently then a normal Battery. It has a seperate court dedicated to those cases specifically. There are some changes that are anticipated in that court room, in addition to som strategy involved.
