Legal Question in Criminal Law in Florida
Bill of Particulars Infants 211
I just asked about bill of particulars infants 211. I will make my question more clear. A 14 year old is accusing her 43 year old stepdad of molesting her. If he files the above motion and she has to be more specific, how can they possible prove or how can he disprove the allegations if they live together?

The fact that two people live in the same household does not keep the State from filing charges. If charges have been filed then the State believes that it can prove the elements of the crime(s) charged beyond a reasonable doubt. Filing a Motion for Particulars is just one step in the discovery process-filing the motion does not mean that the case will be dismissed.
