Bill of Particulars

My question is, if a 14 year old lives with a 40 year old and accuses him of molesting her, and our defense team requests a bill of particulars, how can the defense disprove the exact dates? Or, how can the prosecution prove that these incidences happened on these dates?

Depending on the case the State will provide a range of dates when the conduct took place. For example "between June 2004 and April 2006" Or if it was a few times they can provide exact dates. The dates are proved by the victim's testimony. Unless the Defendant was living out of the country or the victim was, the dates will not be the best avenue of attack.
