Blackmail and Extortion

My ex-girlfriend popped her top so I could snap a picture of her bare breasts. She just dumped me and now wants the 2 pics and the negative. I emailed her and said if she gave me the $150 she promised for new tires for my car on Valentine's day she could have them back. She called my mother and threatened to file a police report for blackmail.

Does she have any cause since the pics were taken with my camera and film and she willingly pulled her shirt up so I could snap them? What happens when somebody files a police report like this?

When somebody files a police report it is then sent to the State Attorney's office. At that point it is reviewed and then a decision is made whether to file charges or not. This decision is made by an attorney, who looks at the facts and determines if the case is worth taking in front of a judge, and if the crime is something they can enforce, and/or win at trial. This case, at first glance seems like a case that the State would not want to be bothered with. BUT you never know?? The best advice I could offer is stay away from this person, and do not use these photos in any way that might harm this person. Ask her for the money she owes you on the tires and keep these photos out of the discussion. GOOD LUCK...
