Blackmail?
If a person committed a sex crime against you when you were ten years old, and 38 years have passed, you want retribution without publicity, would it be illegal to ''settle out of court'' with this individual for an agreed upon sum of money?

I would need more information to give you a complete answer to this question. From what you've told me, the statute of limitations expired 10 years after you turned 18, and the statute of limitations may have expired on any civil liability.
