Legal Question in Criminal Law in Florida
My boyfriend was arrested for Attempted murder, and Robbery with a firearm. He's been in custody for 3 weeks, with no charges filed yet. How long does the state has to charge before they have to release him if no charges are filed. He's in Orlando, fl jail! I read that the state has 33 days, no longer than 40 days. A friend that work at the jail he's currently in says the state has no time limit.

The state must file charges within 33 days or else they will need to release him on his own recognizance. If you need help with this case or have other questions please call my office at 305.670.3119.
