Legal Question in Criminal Law in Florida
My boyfriend was arrested for battery. I told prosecutor I would not press charges but state is. His attorney wants me to sign notorized paper stating totally untrues. The paper says if I lie I could face 1 yr in jail & fines. They say I will not get in trouble & his case will be dismissed. Should I sign it?

The State makes the sole decision as to whether or not to pursue charges. No lawyer can guarantee that your signing a document will get the case dropped. You should not sign a sworn document if you know the document is false. You certainly can write a letter to the prosecutor requesting they drop the case but the decision is up to them. That or have the lawyer rewrite the letter so that it is not untrue.
