Legal Question in Criminal Law in Florida
My boyfriend ran away two nights ago. He brought a bb gun for protection. He was in a guys yard and the guy freaked out and thought he was breaking in and came towards my boyfriend. My boyfriend shot the bb gun to the side to scare him but the guy thought it was a real gun and calle the police and he got arrested. He is 16 years old. They are trying to charge him with aggravated battery & armed robbery. The hearing was yesterday & they are now deciding weather they want to charge him as an adult & have him in jail for 10-20 years. He's only 16 and it was only a bb gun will they really put him in for 10 years? Is there any other possibilities? PLEASE help.

Yes it is possible. They can and probably will charge him as an adult. Using a bb gun is still enough in the eyes of the law if the person believes that it was a real weapon. Since he used a gun to impose fear that is a serious crime.
