Can someone with brain Damage be jailed and made to stand trial They will alaways be incompentent because brain injurys dont go away what will they do

Both sides will have him evaluated. The court will then decide if he is competent to stand trial. If he is, then yes he could be made to stand trial, but he would be able to assert an incompetency defense in the right circumstances.
