Legal Question in Criminal Law in Florida

broken trust

my mother at age 91 signed a paper giving my brother all her money that was given to her by her brother. She was in an assisted living home and had Dementia. This paper she signed would be confusing to a normal person. I did not think you could brake a trust when you are incapable of living on your own. What can I do about this action my brother did? If he did wrong I want proper action to take place. My uncle's will says the money was to be used for her care,my brother was executor of her estate and did not use this money for her care,he used money from her accounts to pay bills. She died 15 months latter, my cosin from Arizonia called me and told me about this money. My brother lied and told me that the cousins got the money.I had an attornry find out about this paper she signed and he dropedme. Isn''t it against the law to do what he has done?

Re: broken trust

It is possible that what was done was improper. I will need more information from you before I can answer your questions. Things such as when did Mom die? Did she have any other assets at the time of death? Talking to an attorney is the right thing to do here. I don't know why the attorney you talked to "dropped you." I have over 30 years of experience and have dealt with a number of these types of situations. They often lead to lawsuits being filed. I will be happy to talk to you without any obligation or cost if you email your contact information or call me.

Good Luck
