Legal Question in Criminal Law in Florida
My brother was charged with Armed robbery and drug possetion
The situation is that my brother apparently was involved with a theft that occurred 2 days ago, and was arrested yesterday. The police officers did not read him his miranda rights, and they police officers found drugs on another person at the scene, the other person who possessed the drugs accused my brother and the police took the drugs and told him to leave if he didn't want any problems. There are witnesse's to these events. My question is, that is it possible to press charges against the officer's involved? He was accused of armed robbery just because someone saw him, and a day later he was arrested, but no one was assaulted in the incident which involved a car. How can he be charged with that? Isn't weapon possession supposed to be a separate charge? We do not know what to do, but there are various witnesses that will are willing to testify. I believe that the cops acted wrong on the drug charges, and neglected to arrest the right person. Can a case be made?

You've asked too many questions to be answered in this small a space. If you think the police have acted improperly, you should report them to Internal Affairs.
I'm not sure I understand the rest of your question, but it looks like it's time for your brother to hire a good criminal lawyer.
