Legal Question in Criminal Law in Florida
Hello, my brother is incarcerated at a Southern FL facility serving 2 � years to date; he maintains his innocence of the charges against him (based on word say) and has requested a hearing for a motion to appeal founded on several FL Statutes. They have twice delayed his hearing and he is waiting on a third reply next week. How many times can the Prosecutor/Judge continue to delay my brother�s hearing? What more can he do or what else is needed to file next in his behalf?

This should be asked of his attorney. Appeals and 3.850 motions don't have a time limit. Some take several months, and others can take years. Again, you should either hire or discuss this with your attorney.
