Legal Question in Criminal Law in Florida
My brother is set to go on trial for grand theft in Florida, however about a week ago he had a massive stroke. He is unable to speak and is confined to bed.His doctor says it could be years before he recovers if ever. What will happen now, will his case be dismissed or will they move forward with it? Who makes that decision the judge? Will they make him appear in court?

You should being asking his attorney this question. His attorney will probably move to continue. It is unlikely it will be dismissed, but it depends on how his health issues play out. And yes, the judge makes that final decision.
