Burglary definition

My daughter was arrested while viewing an unlocked rental unit in Gulf Breeze with the realtor's consent. How can the Police charge her with Burglary and arrest her without Mirandizing her, when the entry was authorized and there was no felony committed? I had to bail her out and have to bring her back to a July 30th court date. I cannot afford a criminal attorney and my 23 year old cannot afford a criminal record. What do I do to prepare for this court date? Afterwards, do I have any recourse against the Police Dept?

She must have an attorney navigate her through the process. Even a well meaning mother cannot give her the advice she needs. She will be appointed a public defender if you cannot afford private counsel.

Make sure you provide the name and contact number of the realtor to the arresting agency and State Attorney's Office. Miranda is only an issue of she was questioned after arrest.
