Legal Question in Criminal Law in Florida

Burglary and Theft

My boyfriend has been charged with Burglary and Grand Theft. The girl whose apartment it was that called the cops is pressing charges but we are told she is moving and might not be here for the court date. If she is not there then is the case dropped? Or does the case then get turned over to the State and it doesn't matter if she goes or not? Or if it is not dropped is there a better chance for my boyfriend if she isn't there? All the items were returned to her and my boyfriend told them the truth from the start and what he took that was later on found in my apartment.

Re: Burglary and Theft

Typically if there is other evidence like a 911 call or something like that the state can go forward without the witness. I've done a great deal of these types of cases and the state will usualy go ahead with the case if there is anything they can use. If you need any more help, feel free to call me.
