burglary and theft

my brother, 18 yrs, was with 2 friends who had the key to the consetion stand. a friend said for them to go in a get candy. the friend used the key that the coach gave him and opened the door. all three boys took some candy, less than $10. a coach saw them, took the items and wrote a referal. the next day the boys came to school and spoke with the dean. at that point they were arrested and charged with burglary and theft. what can we do to fight this and keep it off of my brothers record? why did they charge them with burglary and theft? is the coach liable at all for giving a student the key? can they arrest them the day after? please let me know. thank you

He is charged with burgalry becuase it is "entering and remaining in a structure with the intent to commit a crime. The theft is that crime. Th key and coach don't really matter. They can arrest the day after. He needs a lawyer. Let me know if I can help.
