Re: C4 hearing

A C4 hearing refers to the hearing in which a defense attorney will argue a C4 motion.

A C4 motion is a nickname for a "Sworn Motion to Dismiss".

In this motion the defense is stating that the facts of the case are not in dispute and further that these undisputed facts do not constitute any crime.

It is a motion that is filed pre-trial and is actually signed by the defendant his or her self.

If the prosecutor does not respond to this motion then the charges can be thrown out.

The nickname (C)4 comes from the subsection of the Florida Statutes where the motion is codified.

If you would like help with this motion, or any other criminal issues, feel free to give me a ring.

My office is here in Broward.
