Legal Question in Criminal Law in Florida

car accident

Is it the law to be sited a ticket if, coming out of a parking lot onto a hwy, and the car in front of you starts to go and then stops and you hit them? You were not even moving 10 mph, and they addmitt they started and stopped, and you get sited for wreckless driving. Is this right or was it because the care in front of you was an off duty cop? No was hurt no damage to my vehicle, little to other, I drive a Tahoe and he had sunfire. Thanks. Jason Ross

It is up to the police officer to make a determination who is at fault. I can only surmise that you might have been cited with failure to have your vehicle under control or following too closely. Regardless, the person who is behind is generally cited as you are the one who has the opportunity to avoid the accident.
