Legal Question in Criminal Law in Florida
caught driving outof state w/ a revoked DL
I got caught driving in FL w/ a revoked Virginia DL. What sort of outcome can I expect? Do I have to come to FL to get this thing taken care of? Will this affect any probation in VA? Is there an Interstate database were an arrest in FL would raise a flag in VA?My attorney in VA has advised me to take care of this issue ASAP because that would definitely put me at a higher risk(i.e. unpaid fees, not showing up for court). Please any input on this would be greatly appreciated.

Re: caught driving outof state w/ a revoked DL
I just read your question, saw a couple of responses, but want to give you a source in North Fla. if you need it. Your atty. is correct, if you ignore this, it will cost more later and you may get arrested on the Fla. capias, if one gets entered.
You could have an atty. handle this for you without the need to come down here. As to the outcome, if you do not have a lot of prior "issues" involving crim. law and they are not for susp. lic., the State atty. and the court won't be that worked up over this. In No. Fla., they want you to show them you got your D.L. reinstated. If so, they will only order court costs...with time to pay them. Good luck. Let me know if I can be of any assistance in No. Fla. Tom Rosenblum.

1) Depends on the county you were stopped. I practice primarily in Dade, Broward, Palm beach, Collier and Monroe. Each county handles Driving while license suspended in a different matter.
2) No, you can take a plea in absentia.
3) Yes, there is a database that could raise a flag in Virginia.
I agree with your lawyer in Virginia. Let me know if I can be of further assistance.

I agree with the other response with an additional comment.
1. Was it charged with or without knowledge. With Knowledge is a criminal citation and without is a civil infraction.
I cover primarly Pinellas, Hillsborough, Pasco and Manatee Counties. Let me know if I can be of any further assistance. An attorney can get this expedited for you.
