Caught in Shoplifting

My wife was on a casual visit of walmart with my son in stroller. She was not having shopping cart with her. She was putting the shopping items in the baby stroller itself. She had taken a pair of ear-rings but she didn't put them in the stroller as it was too small item.Therefore she kept it in pocket, but at the checkout register she forgot to pay because of the baby started crying. Later on she was caught by the security officers uner the case of shoplifting. She need to appear in court at the end of this month. Putting the jewelry in pocket gives an obvious intention of theft, but this was definitely not the intention. Please suggest us what to do. Should we hire a lawer for this?
