Legal Question in Criminal Law in Florida
what are chances of absconder going to canada and fight extradition
1 Answer from Attorneys
The answer depends on how badly Florida wants you. If you "fight" extradition, Canada has to have a legal basis not to extradite you back, and that has to be a VERY strong reason, of which there are very few. For example, if you flee to Canada because Florida said they are going to execute you for a misdemeanor, then Canada would probably refuse to extradite. On the other end of the example scale, if you flee thinking, I was only charged with a misdemeanor battery and I'll fight extradition, that does NOT mean Canada won't willingly hand you over to Florida, because they will. The question is not what are your chances if you fight it, but what are your chances that Florida will actually extradite. I've seen it happen for some lesser felonies but unless it is something "serious" Florida may decide not to extradite you. That does not mean the warrant goes away, and it will in fact stay there forever until you either hire an attorney or come to Florida, willingly or unwillingly. I suggest you contact an attorney before you do anything.
