Legal Question in Criminal Law in Florida
I was charged with domestic battery, aggravated battery against a pregnant person, and child abuse. I accepted a plea deal and pled no contest to lesser charges of simple battery/assault and the child abuse was dropped. Adjudication was withheld. Am I eligible to have my record sealed in Florida?
My case number is 532009CF00492701XXXX

Assuming you have not been convicted of anything else, then the answer is probably. I say probably and not definitely because it depends on whether the charge was amended on the domestic battery. A domestic is also a simple battery, but a simple battery is not necessarily a domestic battery. It makes a difference because a domestic battery can never be sealed or expunged even if adjudication was withheld. After you have completed everything, you should talk to an attorney to see if you are eligible.
