Legal Question in Criminal Law in Florida
I was charged with drug trafficking and I'm facing 3 yr mm. At the time my father had recently passedbbaway and I was suffering from depression. Can this be considered a mental illness that would warrent a downward departure?

Depression can be a mitigating factor in some crimes. But, drug trafficking? I don't understand how that defense would work ('your honor, my client was so distraught over the loss of his father, and in his grief, he felt compelled to sell drugs'). You should certainly discuss it with your attorney.
