Charges changed
I am a nurse and was arrested for lewd and lascivious of elderly with dementia but i was subsequently charged with battery on elderly. How can they say I touched her against her will if she has demntia and never objected to care provided?

Certain touching, and whether it was "unwanted," can be inferred from the circumstances. I would discuss the issue with an experienced criminal defense attorney.
