Legal Question in Criminal Law in Florida
My child 15 was in a fight @ school and is being arraigned for battery(mis) how ever the other child threatened to come to our home and shoot him and our family how can I deffend him?
1 Answer from Attorneys
The best thing you can do is to hire him a lawyer. It may sound clich, but the truth is that hiring him a lawyer who can devote personal time and attention is the best thing you can do. He will be charged as a juvenile and the outcome can vary depending upon the facts of his case and his background. Ultimately, his defense that the other child threatened to come to his home and shoot him and his family will not be a defense. Did he report the child to a teacher at school? To the school resource officer? To his parent? Ultimately, "self defense" only works as a legal defense when one can demonstrate that the battery was necessary to combat the reasonable expectation of force in kind. Regardless, he needs a lawyer.
