can you be tried in both civil and criminal court for the same charge of grand theif and the amount taken was approxiametly 6000.00 and you have already paid back 5000.00 this is the first offense but the guy is out for the heart. what happens from this point

YES... He can sue you for restitution damages, and of course, you can be tried criminally... GOOD LUCK.
