adjudication of guilt was withheld in my case of Felony Battery. I am told I can get my record cleared now that I am off probation, but the courts cannot tell me how to do it? I have asked several staff members if I was charged with domestic or not and I have no where else to turn, please help me

Re: clearing my record

What you are talking about is a record sealing/expungement. As long as you have never been convicted of a crime and have no prior expungements you are entitled to do so. There are forms available from FDLE, or any State Attorney's Office. If you want to retain counsel to do it for you please contact my office.

Re: clearing my record

If the battery case is domestic violence related, it cannot be sealed or expunged. In order to find out, you need to look at the court file and see what statute the state attorney charged you under. If not domestic violence related and you have never been convicted (adjudicated guilty) of any other criminal offense, the case can then be sealed. NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Of course, you can turn to the assistance of any attorney if you chose but apparently do not wish to do so. If you want to attempt this by yourself, you can try to file a Motion to Seal or Expunge your record. Copies of the Motion and Orders are generally available on your local court's website and at the FDLE. The clerk's office at the criminal court should be able to provide information on applicable filing fees and requirements.
