Community control
4 years ago my son was sentenced to prison for 4 years and 2 years probation. Since his release in December 1999, his paper work has come back community control. This was not part of our plea agreement. However, at the time of his sentence, I was told what the agreement was and was not given the opportunity to review the agreement (he was a minor at the time-sentenced as a youthful offender). What procedures do we need to pursue in order to commute community control to probation?

First you need to know if this "community control" is probation as defined under the juvenile sentencing. If it is then juv. cc is a VERY, VERY minimal probation, and is a cake walk for most people. In fact it is less stringent then normal probation. So don't rock the boat. But if it is adult cc that's another matter that should be addressed by an attorney in a motion called a Writ of Corum Nobis. Long story... call an attorney for more help. GOOD LUCK.
