Legal Question in Criminal Law in Florida

conditional clemency

I was released from a Florida state correctional facility in July of 2002. My life has totally changed and I am interested in obtaining a conditional clemency. I have letters of recommendation from the community in which I now live, also from my Pastor and former employers. My question is, what are the general lenghts of time before conditional clemency's are granted? Also, what are the conditions imposed. I recently celebrated 3 years of soberiety. I have had no infractions of any kind, thanks to Gods grace. Appreciate any help. God Bless. Just for further information, my arrests were felony drug charges. Also have extensive misdeamnor record. All in the State of Florida.

Re: conditional clemency

First I would like to congratulate you and I commend you on your reform.

What you are seeking is officially known as executive clemency (aka Civil Rights Restoration). It is a rather simple process and does not require an attorney, although one can sometimes help.

Also, the governor has recently streamlined the process to make it easier for those convicted of non violent felonies. For violent felonies there is a required waiting period of two to three years before your application will be considered.

My website provides information and links on obtaining executive clemency, as well as the forms you will fill out.

Best of luck to you in the new year,

Re: conditional clemency

I am not sure if you are seeking clemency or restoration of your civil rights such as voting, owning firearms etc. I agree with Mr. Hornsby, the process is simple once you have the forms. I direct you to http://www.state.fl.us/fpc/20041209News.htm which answers all your specific questions. In some jurisdictions the public defender will help you with the paperwork. Good Luck!
