Legal Question in Criminal Law in Florida
conditional release transfer to Florida from Wisconsin
We would like to transfer our 40 year old son's conditional release from Wi. to Fl. because we want to move there. He was found NG, by mental illness,(6 felonies), 12 years ago. His illness has been completely under control for years. Wis. put his conditional release up to the year 2013. Since Florida has a two year CR limit, and he already has been out, on conditional release, for one year and if Florida accepts him, would he serve one more year or two? Thanks so much, A concerned Mom.

Re: conditional release transfer to Florida from Wisconsin
As always, proper legal advice requires a full consultation with an attorney, and may require additional information.
Generally speaking, the Conditional Release is monitored through supervision essentially the same as probation. If supervision is transferred to Florida from another state, the fact that Florida is conducting the supervision will have no effect on the sentence. If the WI Court ordered supervision through 2013, that term will not be altered simply because Florida agrees to supervise the sentence.
