"is it still considered a burglary, if you weren't proven to be commiting an unlawful/illegal act besides tresspassing or criminal mischief?" and "if youre only accused of burglary and larceny, does disproving the larceny beat the burglary?"

Yes it can be burglary, and no, disproving the theft, does not necessarily beat the burglary charge.
