Legal Question in Criminal Law in Florida
What constitues someones legal residence in the state of Florida?
One of the charges that someone has is
Burglary of an occupied dwelling -
unarmed and it carries a LIDE sentence.
The legal definition of burglary is the
illegal entry of a dwelling with the intent
to commit a crime. If this person gets
his mail at the house/dwelling where he
was charged, then is that his legal
residence? If this is true then I don't
know how they can say he illegaly
entered, since he receives his mail
there.

That is one factor to be considered. I would need to know more of what your friend's connection to that house is. What county is this? You can call me at my office for a free consultation.
