Legal Question in Criminal Law in Florida

Used copied key to enter business at night didnt take anything is this burglary!

I worked at a shop and told them to take me off the schedule for the next week and she asked me if I wanted to quit i said yes and she said i would have to talk to the owner before i could they wouldnt give me my check then i went back to the store the 4 days later entered the building with my wife with a copied key, to get my check and I didnt take anything or hurt anything and the mangager walked in. AT 1:30 in the morning is this burglary of a second degree. There was know one in there, no guns, violence, just normal talking and left the building when told too. Then I was arrested for second degree burglary can they make this stick if i fight it with a lawyer. Thanks

Burglary is defined as entering and remaining in a structure with the intent to commit a crime. I can't tell whether they could prove it or not because there are not enough facts presented. Yes, you should hire a lawyer. A second degree felony is punishable by 15 years in prison.
