copping a plea
Can the state offer a plea if it is your second vop (originally convicted as felon for battery/criminal mischief) and your original sentence was 3 yr probation with 5 yr suspended sentence?

Yes, the State can. The bigger question is will they? And, if they do, will it be something you would consider accepting? After violating probation for the second time, it is likely that they will be seeking jail time. This can vary from jurisdiction to jurisdiction though.
