Legal Question in Criminal Law in Florida

I have a court date next week for a misdemeanor charge. I work in a liquor store for a large grocery chain and I sold to an underage operative of the ATF. I have never been arrested for anything. I expect to pay a fine but I dont want this to appear on my record. Can I ask the judge to withhold judgement?

Yes you can ask. You also may be eligible for a diversion program. If you complete that program, the charges will then be dismissed. I practice in St. Petersburg if you wish to contact me about this further.

You may be eligible for a diversion program, which is run by the State Attorneys Office, not the court system. The diversion program is similar to probation, but you do not have to plea to the charges, and when you complete the program, the charges against you are dropped. Even if the charges are dismissed or adjudication withheld, you will have to take steps to have the record sealed or expunged so it no longer appears on your record. It's not automatic.
