Court Failed To Produce Records

A senior citizen hit a parked car at church. He left after fear of a person that was standing outside of the car screaming. The gentleman was issued a ticket for leaving the scene of an accident. He hired a lawyer, the lawyer asked the court to produce ''records''. They did not after 4 months. There is now a court date. Can this be thrown out because the court did not produce after repeat requests to produce???

The court is under no obligation to produce records. Maybe you mean the prosecution. If so, there is a very, very small chance that the case could be thrown out, but the appellate courts have said not to throw out a case just because there is a delay in producing records.
