can the courts start trail three years later for aggravated assault

It depends. In felony cases a person has a right to a speedy trial meaning the trial must start within 175 days from the date they are arrested. However, if that right is waived then the State has unlimited time to start the trial. The right to a speedy trial can be waived if the defense requests a continuance or if the defendant fails to show up for court. Pretty much any delay attributed to the defense will waive the right to a speedy trial. That being said, the right to a speedy trial can be invoked with a demand but there are serious consequences to doing so. I strongly suggest having an attorney who is capable and confident handle this serious charge for you. If you are not satisfied with your current attorney then you should hire a new one.
