Legal Question in Criminal Law in Florida
credit for all time served
My girlfriend is incarcerated for VOP from a charge dated back in 1995. We are having a problem recieving correct amount of credit for time served on sentence. Judge ordered credit for all time served at sentencing but calculations between judge and DOC are different. We filed a motion to clarify and was granted extra time off, but release date has not changed. Tallahassee suggested to file a reduction of sentence. Very confused about what to do. She is currently in prework release in Bradenton. Case is out of Polk Co. Florida

Re: credit for all time served
How long has it been? Sometimes DOC is slow in changing the release date. Did DOC get the updated paperwork? If that is not the problem, you could also do a motion to correct sentencing time error - have an attorney count all the days, see if the state objects, and if not have the judge sign the order reflecting the proper credit time.
