Legal Question in Criminal Law in Florida

Criminal law sexual battery capital case: My spouse was denied bond at an Arthur hearing. His private lawyer represented him poorly. We used savings but have no more money and he doesn't have a job/income anymore. He wants to file for a public defender and fire his current lawyer. Also we both feel he should appeal with a habeas writ to the supreme court. can he do this pro se and then seek public defender or would the PD have to do it?

He certainly has the right to fire his private attorney. There would then be an investigation to see if you qualify for a public defender, and if he does the court will appoint one. After a public defender is appointed you can meet with them to see if doing an appeal or other post-conviction relief is appropriate.
