Legal Question in Criminal Law in Florida

criminal law

i am 47 year old medical professional and due to hate and vengence i was setup and arressted for possetion and sales of stolen property . my question is because i have never been in trouble my entire life and my career is at stake. what are the charges i can be facing?

Hello:

I just read your question, saw an answer has been provided, but I practice in North Fla. (mainly Jax.)so I'll provide another response. First, I need to state this is not a formal legal opinion as this is not an atty/client relationship. This is merely a general discussion of legal principles in the area of criminal law.

Basically, no one can tell you what possible charges may be filed. The State Atty. decides that. I can say it is very good if someone does not have any prior criminal history when they are charged with a crime. Often, one with no record will be offered a diversionary program by the State. This is where the defendant enters into an agreement with the State Attorney's Office to perform some obligations such as pay restitution or do some comm. service hours. You do not have to accept any agreement. If one knows he/she has done nothing wrong and the State has a bad case, you fight it and perhaps they will drop the case.

By the way, it is difficult for the State to prove someone had knowledge certain property was stolen. I am handling one of those cases now. You mention you may have been setup by someone. This may or may not be relevant. It depends on how much involvemnet that person has in this matter. It may affect that person's credibility. I have a case now where a person agreed to make a few payments for another person's car and electric bill. The electric bill was even in that person's name. Then, when the person paying bounced a couple of checks, she said my client stole her checkbook and forged the checks. She is trying to avoid prosecution for the checks. My client should be ok in that matter
