While the circumstances you are stating are unusual, they are not unheard of. This often happens in traffic court, because the person in a traffic stop gives a false name (usually someone he or she knows) and the authorities pursue the wrong person based upon that info.

My best advice to you is that it would be worthwhile to obtain an attorney to help you with this. They are familiar with the criminal system, and will know how to present the matter to the state attorney if this is a case of mistaken identity. Remember, the prosecutor thinks they charged the correct person, and you will be viewed suspiciously if you just say they charged the wrong person.

Good luck to you.
