Out the two main classifications of crimes in Florida (misdemeanors and felonies), felonies are the more serious of the two. A Felony is any offense where the Court may sentence an individual to Florida State Prison (as opposed to county jail). There are three main classifications of felony charges:

Third Degree Felony

Five (5) years Florida State Prison

Second Degree Felony Fifteen (15) years Florida State Prison

First Degree Felony Thirty (30) years Florida State Prison

In Felony cases, the Court will use a "score sheet" which will determine the type of sentence of received. The "score sheet" is a function of the nature of the pending charge and an individual's criminal history.
