Legal Question in Criminal Law in Florida
criteria for obtaining an arrest warrant
I am attempting to find out the criteria of which a judge uses to issue an arrest warrant. I am posed with a scenario where a judge issued an arrest warrant on the sole grounds of seven witness' identification of a suspect based only on his body build. While the police arrested him on that very limited circumstantial evidence, they also ransacked his house and found a mask that was used in a bank robbery. I want to know if it would be legal for a judge to issue an arrest warrant on such evidence, and if not, where can i find the criteria by which a judge follows in making this decision. Thanks for the help.
