As a general rule, a 17-year-old can legally consent to sex with a person 23 years of age or younger. There are some exceptions, such as a 17-year-old with mental defects. A 17-year-old cannot consent to sex with a person 24 years old or older.

Yes you can, but it is considered a crime even if the 17 year is "consenting". That's because under the law a 17 year old can't legally consent.
