She needs an attorney. She is probably not going to prison, but jail is always a possibility. The maximum penalty for a 3rd degree felony is 5 years in prison.

I recommend you speak to an attorney. My office does free initial consultation. If she has a 1st degree felony - that carries 30 years prison, 2nd degree is 15 years and 3rd degree is 5 years per count. I take it she picked up a burglary and a dealing in stolen property - hence the 1st and 2nd degree charges.

What your daughter faces on paper may be vastly different from what she's actually looking at once the case is thoroughly reviewed by a competent, experienced criminal defense lawyer. Grand Theft is a 3rd Degree Felony, punishable by up to five (5) years in prison per count. Dealing in Stolen Property is a 2nd Degree Felony, punishable by up to fifteen (15) years in prison and scoring mandatory prison if convicted as charged. This doesn't mean that she'll see such a harsh sentence in the event that she's convicted of the offense. Actual sentencing will vary, based in part on victim input, what the overall sentencing guidelines scoresheet indicates is a minimum sentence and what is done during the course of legal representation to address the issues that the case presents. For more information and an in-depth analysis of her case, please feel free to call my main office in Orlando at (407) 657-1555.
