who decision is it to disquality a judge, do they have the final say.

Anyone can move to "disqualify" a judge if they are not qualified. However, I think you are referring to recusal of a judge. The presiding judge is the one that makes that decision and it must based on judicial rules. If a judge refuses to recuse himself, then that issue could be appealed.
