Legal Question in Criminal Law in Florida

Self Defense Question

What situations would permit the use of a taser gun or pepper spray? If I were involved in an argument in public could I tase/spray the person? Would it make a difference if I was inside my vehicle? Is it only legal once the other person has escalated the argument to a physical altercation?

Re: Self Defense Question

If you believe you or others are in danger of death or great bodily harm from another, you may tase or spray the aggressor. It used to be that you only had that right in your home or car, but now you have that right anywhere. Tasers, by the way, and pepper spray in a can greater than 2 ounces require a concealed weapons permit if you carry them on your person or don't keep them in the right place in your car.
