what does down with departure mean? my boyfriend is appealing a case form prison? and i was trying to get an idea of how it goes?

I'm sure you mean "downward departure." That means that a person is sentenced below what the sentencing guidelines. For example, if the guidelines say a person scores 48 months to the maximum statutory sentence, then a downward departure would be one below 48 months.
