Legal Question in Criminal Law in Florida
depositions
My brother is in jail for a sex crime. He gave a statement to the police on the day of his arrest. The victim also gave s tatement that day. 8 months later, our attorney has depositioned the victim, but says that my brother will not be depositioned or questioned again by the state attorney. Why would the state attorney not deposition him or want to hear his side?

Defendants are never deposed. he can take the stand at trial if he so chooses.
